Most new apartments are sold off-plan. How it works in Morocco and how to protect yourself.

Buying off-plan often means a better price, a choice of floor and orientation, and payments spread over the construction period. In Morocco, off-plan sales (VEFA) are governed by law 44-00, amended by law 107-12. Here are the steps and the reflexes that secure your purchase.
The steps of an off-plan purchase
- Reservation contract: sets the unit, price and expected delivery date. The deposit is capped by law (in principle 5% of the price).
- Preliminary sale contract: signed before a notary or authorised professional, usually once the foundations are complete.
- Staged payments: instalments linked to construction progress (foundations, structure, finishing).
- Final deed: signed at delivery, once the occupancy permit is issued and the land title is split.
Guarantees to require
The developer must provide either a completion guarantee or a refund guarantee for the sums paid. The law also provides compensation for late delivery. Get these guarantees in writing and have the contracts reviewed by your notary.
Checks before reserving

Financing an off-plan purchase

- A “commercial” floor area inflated by balconies and common areas: ask for the habitable area.
