Selling an inherited property in Morocco: the steps

After a death, the property is jointly owned by the heirs. To sell it, the estate must first be established and the land title updated, then everyone’s consent gathered.

Establishing the estate

The certificate of inheritance (frida), drawn up by adouls, names the heirs and their shares. For a titled property, it is then registered at the Land Registry, which puts the title in the heirs’ names.

The heirs’ consent

While the property is jointly owned, selling it whole requires all heirs’ consent, in person or through a power of attorney. An heir can also sell their share, or the heirs can partition.

In case of lasting disagreement, partition can be requested in court; an amicable agreement remains faster.

Tax

The sale of an inherited property is subject to the real estate profit tax under the General Tax Code; the purchase value is in principle the value declared on the date of death. Have the notary calculate the tax before setting the price.

Heirs living abroad

Heirs living abroad can give a power of attorney (legalised or drawn up at the consulate) to a relative or the notary. Allow for this in your sale timeline.
